General Notes:
Ellen Searle was entitled to a fourth share of Freehold Estate Albert Lodge and two cottages - Pierpont Cottages - under the will of her grandfather John Field (d. 1828), subject to the life interest of her mother. Her will was made the day before she died, predeceasing her husband, who had made a will six weeks before his death. She had also inherited consols under the will of William Searle (d. 1880), and had purchased further stock, leasehold ground rents in Foster Road, Croydon and Cambridge Road, Thornton Heath, a freehold house at 49 Commercial Road Peckham, Worthing Pier shares, fee farm rent of Mitcham Mills, and the lease of Sunnyside, Peckham Rye. It was queried on her death 1. whether she had the power to make a will during the lifetime of her husband (married women's property act) 2. whether she was in a fit state to make a will since she was in a coma for some time preceding its making and until she died. The signature was apparently not in her handwriting although witnessed by a doctor and drawn up by a 'respectable' solicitor. In an opinion dated 21 Oct 1904 regarding the first point, John Lightwood of Lincolns Inn said that 'the will by which she purported to devise the share of the Peckham Rye property was inoperative. The share descends therefore to her heir-in-law.' The outcome is unknown. 35
Ellen married Henry Charles Seyfang, son of George Bond Seyfang and Elizabeth Mihill, on 12 Jan 1859 in St Giles Camberwell 18. (Henry Charles Seyfang was born on 4 Jun 1836 in Camberwell 19,20, christened on 24 Jun 1836 in St Giles Camberwell 21, died on 6 Sep 1904 and was buried on 8 Sep 1904 in Camberwell Old Cemetery (Forest Hill) 22.)
